Two years ago, on September 10, 2017, a 27-year-old bartender Lindsey Glass was arrested for violating the Texas Alcoholic Beverage Code, ‘Sale to Certain Persons.’

In detail, the code says, the “person commits an offense if the person with criminal negligence sells an alcoholic beverage to a habitual drunkard or an intoxicated or insane person.”

The offense is a misdemeanor, and the person who violates this code can receive a fine up to $500, a year in jail, or both.

This week Lindsey Glass was sentenced to a year in jail, and today, the bar is closed after they lost their liquor license in 2018.

On that night, she served 32-year-old Stephen Hight a vodka shot, two beers, and two gin and tonics at the Local Public House.

While Hight was sitting at the bar, he pulled out a knife and kept saying, “I have to put someone in their place and take care of some dirty work.”

Glass sent a text message to the other bartender,Timothy Brandt Banks, who was off at the time, informing him of Hight’s strange behavior, “Spencer has a big knife on the bar and is spinning it and just asked for his tab and said I have to go do some dirty work… Psychoooooooo.”

Banks went to talk to Hight and told him he should wait to speak with his wife when he was sober.

Banks then called the bar owner, Jerry Owen, asking if he should call 911.

Owens told him “no.”

Banks told detectives, “I let the worst murder in the case of Plano ever happen.” Later, he told the TABC investigator he “didn’t think he should’ve called the police when he saw Hight with a large knife and gun magazine.”

Throughout all of this Lindsey continued to serve Hight.

According to a report from a Texas Alcoholic Beverage Commission (TABC), investigators stated, “Glass should not have served Hight after he was unsteady on his feet and staggered around the bar, running into tables and walking sideways.”

When Hight left the bar, he drove back to his residence where his wife, Meredith Hight was hosting a Dallas Cowboys party.

He went inside and opened fire on his wife and seven others inside the home killing all parties.

His wife Meredith, Caleb Seth Edwards (25), Anthony ‘Tony’ Michael Cross (33), Myah Sade Bass (28), Olivia Nicole Deffner (24), Rion Christopher Morgan (31), James Richard Dunlop (29), and Darryl William Hawkins (22) were all pronounced dead at the scene.

Someone reported the shooting to the police and during a conflict between Hight and the Plano Police, he was shot and killed.

His blood alcohol level was four times the legal limit of the state of Texas.

Glass was also supposed to be at the party that night but was working that night at the bar.

It was reported Glass, and Hight knew each other.

During Glass’ trial, her attorney, Scott Palmer, was against the charges filed against her, and put out the statement, “It is shameful of the Plano Police department to go after the person who was vital in trying to stop the horrific events of that evening.

This arrest is not in the interest of justice and appears to be a last-ditch effort by the Plano PD to make someone pay.”

He also added the Plano Police officers commended Glass on how she handled the situation which had saved lives.

Palmer stated, “It is shameful of the Plano Police department to go after the person who was vital in trying to stop the horrific events of that evening.

This arrest is not in the interest of justice and appears to be a last-ditch effort by the Plano PD to make someone pay.”

A tweet was put out by Jobin News this week from Jobin Panicker after the sentencing, “Now available court docs show how many drinks Spencer Hight may have been served before a shooting rampage in Plano nearly 2 years ago. Bartender was just arrested for TABC violation. Docs show Hight had 2 gins, 2 beers, and 1 shot. His BAC was .33. Four times limit.”

The commission’s executive director of the TABC, Bentley Nettles put out a statement, “This case shows the critically important role that TABC-licensed businesses play in upholding public safety. Anyone, including customers, business owners, or employees, should contact their local police any time they suspect a threat to the public. In some cases, shootings like this can be stopped before a life is lost.”

Pretty cowardly and small of the PD to use her as their’ scapegoat when she is the one who spoke up and alerted the authority-in-charge (the bar owner) as to that patron’s mental state and condition. Shame on them! Seriously! Have the nerdly, geeky feminized boys invaded the roles of the Law Enforcement Academies now? Real-Men-wannabe’s running from responsibility for doing real, conscientious investigating find the lowest person on that totem-pole to shift all the blame onto? Shame! Shame on all of you! I pray God will intervene on behalf of true justice!

  3. Seems to me the 2 year sentence is right on the money. I have been a bartender. I have been a bar owner. I have been wrongfully imprisoned before by a overzealous and clearly wrong prosecutors. No one wins here. Many died here because of it all. Everyone was wrong here. It NEVER had to happen if the bartender called the cops and related the very real threats.

  7. Well I know how you can be drinking five Alcoholic drinks and how long was he.at the bar. And then how many Alcoholic drinks did he have after he left the bar and how many more did he have after he left the bar? And how was his BAC was .33. Four times limit when he only had 5 drinks in at least one hour or more. then he would only have about 4 drinks in him and his BAC level at the most should have been about .01 not .33.

  8. there is no legal blood alcohol limit to drink, there is a legal blood alcohol limit to drive .08 %. 2 beers, two drinks, and 1 shot would not bring someone’s blood alcohol anywhere near .33, you also need to know how long he drank this alcohol. generally speaking each drink or beer will increase your blood alcohol .02, a staight shot of 100 proof maybe .03.

  9. Well, she did follow the boss’s orders but the problem is if she had refused to serve him he would had no doubt shot her since he was after shooting someone that night. Hindsight is always great but when you are in a situation with drunks you hope they will eventually leave. I would have gone to the bathroom and called the police and hope the guy wouldn’t show up at the bar the next night which is what drunks will do. Since he went straight to his wife even if she called the police it wouldn’t matter if she didn’t know where the heck he lived. The time it would take the police to track the drunk would have been too late any ways. The boss should have called the police or gone in to see what was going on. He is the one responsible for the business. The drunk was going to kill someone that night and he did but maybe he would have just slept his drunkeness off, who knows. That’s life sometimes.

  10. I am no lawyer, but it seems to me the bar owner, Jerry Owens and the other bar tender Timothy Banks share in this situation that resulted in the murder of 8 innocent people. Again, I am not a lawyer; however, I think Owens should have instructed his staff to call the police and Banks should have done more than just tell Hight to speak to his wife when he soberred up–he should have called the police opposed to calling the owner; especially after seeing Hight with a large knife and gun magazine. I think, Glass’ lack of taking appropriate steps is much worse…she should NOT have continued serving Hight and immediately called the police (rather than an off-duty bartender). Continuing to serve someone who is displaying signs of intoxication and especially weilding around a knife and threatening harm sounds as though it could fit a crime of aiding and abetting an involuntary manslaughter (which is a killing that happens because of recklessness or criminal negligence). If all 3 of these people would have acted responsibly and as the law required when serving alcohol, Hight would have been arrested and the lives of 8 innocent people would not have been lost!

  11. Glass is the scapegoat in this situation. She did her duty by reporting the situation to her employer. The employer, when notified of the situation. declined to call 911, thereby allowing the problem to escalate. The owner should be serving Glass’s sentence.

  12. As a bartender, she is required to obey the law just like the rest of us. Continued serving of an intoxicated customer, even if you know them is, no excuse, especially one that has a weapon displayed and is making comments like Hight was doing. She should have called 911 , 7 people would still be alive today more than likely. The owner should lose his lic. since he told the off duty bartender not to call 911. Trying the “but the Boss said No” is a BS excuse.All involved got what they deserved. Except the dead.
